Congratulations on the purchase of your new home! Welcome to our neighborhood. You are now part of the Benedict Hills Estates Homeowners Association ("BHEA"). The following information is provided to tell you about our area.
General Information about the Community. BHEA is a planned community of 229 lots for the benefit of all members to ensure consistency, uniformity, aesthetically pleasing conditions and environment, and to maintain the integrity and stability of the natural environment and man-made terraced slopes. BHEA owns no common area or other property.
BHEA has no powers to act in any other matter. It is not a political entity. Political issues can be handled through the Benedict Canyon Association, a voluntary organization which represents the homeowners throughout the entire Benedict Canyon area.
BHEA exists by virtue of its corporate Bylaws and governed by the recorded Covenants, Conditions and Restrictions (CC&Rs for short).
While the CC&Rs provide for enforcement of certain rights and impositions of certain limitations, generally speaking, BHEA is not a body to which neighborhood disputes should be presented for resolution. Certainly, if a homeowner or group of homeowners are not complying with the CC&R, or if there is a violation under the CC&Rs, it is the responsibility of BHEA, through its Board of Directors and/or designated committees, to identify the problem, address the violator with proper notice, attempt to effect a resolution, and if one the CC&Rs.
BHEA's functions are to:
(1) oversee the hillside slope areas (including maintenance, watering and care of the controlled sloped areas). Maintenance personnel are in the area daily;
(2) maintain an outside contract for drive-thru security patrol of the neighborhood; and
(3) maintain the aesthetic integrity of the community by having an architectural committee review the plans for new homes and also plans for exterior revisions to existing homes, including color changes.
In general, the Board is responsible for overseeing an annual budget of about $200,000 which is used for landscaping, security, utilities, management, consulting and accounting and legal fees. The members of BHEA's Board of Directors are homeowners who volunteer their time and energy to maintain a quality neighborhood. These members truly appreciate hearing when things are going right as well as when something needs attention.
